For many refugees in the Netherlands, temporary jobs and agency work are often the main gateway into the labour market. However, these types of jobs are frequently linked to instability, whether in income, working hours, or the ability to plan for the future. In this context, the Dutch House of Representatives recently approved a new bill aimed at giving workers with flexible contracts more security and stability.

The Netherlands currently has around 2.7 million flexible workers, one of the highest figures in the European Union. According to the government, this situation has created uncertainty for many workers, especially young people, migrants, and refugees, many of whom depend on this type of employment.

One of the most significant proposed changes is the abolition of “zero-hour contracts,” which allow employers to call workers in without guaranteeing a minimum number of working hours or stable income. Instead, new contracts would include a minimum and maximum number of hours, with the maximum not exceeding 130% of the agreed minimum.

The reforms also aim to tighten rules around repeated temporary contracts, in order to prevent what is often described as a “revolving door” system, where employers repeatedly rehire workers on temporary contracts to avoid offering permanent positions. Under the new rules, it would become more difficult to continue using temporary contracts in this way.

In addition, agency workers would receive rights and working conditions more equal to those of permanent employees, including in areas such as holidays, training, and pensions.

These changes could be particularly important for refugees, as stable employment is often a key step toward building a secure life and integrating into society. More predictable income and working hours could help many people better plan for housing, education, and daily life.

While labour unions have broadly welcomed the reforms, some business groups warn that the new rules could reduce labour market flexibility and increase costs for employers.

If the Senate also approves the legislation, most of the measures are expected to take effect in 2028. Between protecting workers and maintaining economic flexibility, the debate over the future of the Dutch labour market is likely to continue.

وتشير الأرقام إلى أن هولندا تضم نحو 2.7 مليون عامل بعقود مرنة، وهي من أعلى النسب داخل الاتحاد الأوروبي. وترى الحكومة أن هذا الوضع خلق حالة من عدم اليقين لدى كثير من العمال، خاصة الشباب والعمال المهاجرين واللاجئين، الذين يعتمد عدد كبير منهم على هذا النوع من الوظائف

أحد أبرز التغييرات المقترحة هو إلغاء عقود “الساعات الصفرية”، التي تسمح لأصحاب العمل باستدعاء الموظف للعمل دون ضمان حد أدنى ثابت من الساعات أو الدخل. وبدلاً منها، سيتم اعتماد عقود تتضمن حداً أدنى وحداً أقصى لساعات العمل، بحيث لا يتجاوز الحد الأعلى 130% من الحد الأدنى المتفق عليه

كما تتضمن الإصلاحات تشديد القواعد المتعلقة بالعقود المؤقتة المتتالية، لمنع ما يعرف بـ”الباب الدوار”، حيث كان بعض أصحاب العمل يعيدون توظيف الأشخاص بعقود مؤقتة بشكل متكرر لتجنب منحهم عقوداً دائمة. وبحسب التعديلات الجديدة، سيصبح من الصعب إعادة استخدام العقود المؤقتة بعد انتهائها

كذلك، ستحصل فئة العمال عبر مكاتب التوظيف على حقوق وظروف عمل أكثر مساواة مع الموظفين الدائمين، بما في ذلك الإجازات والتدريب والتقاعد

وقد تحمل هذه التغييرات أهمية خاصة للاجئين، إذ إن الاستقرار الوظيفي يعتبر عاملاً أساسياً في بناء حياة مستقرة والاندماج في المجتمع. فوجود دخل أكثر ثباتاً وساعات عمل أوضح قد يساعد الكثيرين على التخطيط بشكل أفضل للسكن والتعليم والحياة اليومية

ورغم الترحيب الواسع بهذه الإصلاحات من النقابات، يحذر بعض أصحاب الأعمال من أن القوانين الجديدة قد تقلل من مرونة سوق العمل وتزيد التكاليف على الشركات

وإذا وافق مجلس الشيوخ أيضاً على القانون، فمن المتوقع أن تدخل معظم هذه الإجراءات حيّز التنفيذ في عام 2028. وبين حماية العمال والحفاظ على مرونة الاقتصاد، يستمر الجدل في هولندا حول الشكل الأمثل لسوق العمل في المستقبل
